Broker nonpayment and bond claims: prepare your evidence
Before pursuing an unpaid invoice, verify the contracting broker, payment terms, outstanding balance and financial-security provider for the relevant period.

Reconcile the amount owed
Make an invoice ledger showing the agreed rate, approved extras, payments received, disputed deductions and remaining balance. Record when and where the invoice was delivered. Separate an agreed debt from a contested charge.
Identify the financial security
FMCSA financial-responsibility materials distinguish a BMC-84 surety bond from a BMC-85 trust. Use official Licensing & Insurance records and verify the provider, filing dates and claim instructions. Broker financial security is not cargo insurance.
Build a reviewable claim packet
Explain the transaction in plain language and include relevant records. Ask the actual provider which additional evidence it needs.
- Broker legal name and official identifiers.
- Load details, rate agreement and approved amendments.
- Signed delivery evidence and invoice.
- Payment terms, balance calculation and communications.
- Any assignment/factoring documents relevant to who may claim payment.
- A dated index of attachments and proof of submission.
Understand the limits
A claim is evaluated on its facts and applicable rules. Coverage, competing claims and disputed liability can affect recovery. FMCSA’s financial-responsibility overview identifies requirements effective January 16, 2026. Verify the current rules and your particular claim period; there is no universal payment promise.
If the claim is disputed or denied
Keep the stated reasons, compare them with your evidence and prepare a factual request for review where appropriate. Seek qualified legal advice about suit, insolvency, deadlines or disputed coverage. This site provides education and does not submit a claim or collect a debt.
